Egg, Sperm and Embryo Donation Agreements
Donor contracts are written agreements between recipients and their donor documenting their intent for the donor to donate his or her sperm, eggs or embryos to the recipients for their use in becoming a parent. The donor contract should address issues such as confidentiality of identities and future disclosure of the donation to children, parental rights, liability for health complications, disposition of excess embryos, and the level of continuing contact between the parties.
Donations are based on state law. Although virtually all states have laws governing sperm donation, many states still have no specific laws governing egg or embryo donation. Every donation is unique, and factors such as residence of the participants and marital status can have a significant impact on the legal rights of the parties.
